描述.This book contributes to the increasing interest in John Adams and his political and legal thought by examining his work on the medieval British Empire. For Adams, the conflict with England was constitutional because there was no British Empire, only numerous territories including the American colonies not consolidated into a constitutional structure. Each had a unique relationship to the English. In two series of essays he rejected the Parliament’s claim to legislate for the internal governance of the American colonies. His .Dissertation on the Canon and Feudal Law. (1765) identified these claims with the Yoke, Norman tyranny over the defeated Saxons after 1066. Parliament was seeking to treat the colonists in similar fashion. The .Novanglus. essays (1774-75), traced the origin of the colonies, demonstrating that Parliament played no role in their establishment and so had no role in their internal governance without the colonists’ subsequent consent.?.

Is There a British Empire?,itories that the king of England ruled in one or another of his multiple capacities? To answer this question Adams turned to the history of English acquisition of the lands commonly termed the British Empire and how were they governed.

Daniel Leonard and the Modern British Empire,mpire, and questioned whether there really was such a constitutional entity. Adams responded with the . essays, denying the existence of a British Empire. These two sets of essays are the best expositions of the conflicting positions on the constitutional issues involved in the Revolution.

Imperial Origins: Wales, Ireland, and America,ied imperial structure in Leonard’s sense, a coherent and unified constitutional structure, only various peoples subject to the king of England in his various capacities. Adams examined the history of English relations with Ireland, Wales, and the American settlements to support his argument.

Empire by Consent,cognized in the founding documents or was subsequently recognized by constitutional action. Parliament’s unilateral assertion of jurisdiction over the American colonies was a tyrannical imposition, the yoke, because legitimate English government required the consent of the governed something that the colonists had never been granted to Parliament.

Conclusion,ganizing and consolidating the numerous territories that would form the British Empire into a coherent imperial structure, Adams argued that such could not be done without the consent of the governed, that is, the English colonists and their descendants.
