The Registration Procedure,On the basis of the Benelux Trade Mark Law no one can ‘regardless of the claim he makes legally invoke protection for a sign that is considered as a mark in the sense of Article 1, unless he has deposited it in the regular manner ...’ (Article 12,A). In other words: in Benelux the deposit of a trade mark is a condition of protection.
